Terms and conditions
Kings of Advidi (“The Contest”) is an initiative of Advidi - Bang! Media Group B.V (“The Company”) registered at Watertorenplein 8 1051 PA Amsterdam. As an affiliate (“Participant”) taking part in The Contest, you agree with the Affiliate Terms and Conditions of The Company, and with the terms and conditions of the contest. The Contest will be governed and construed in accordance with the laws of The Netherlands and Parties submit the jurisdiction of the courts of Amsterdam, The Netherlands.
Contest details and terms and conditions
Only affiliates who are active participants in the Advidi performance marketing network (Advidi) may become Participants in The Contest. Active affiliates who joined Advidi before 1 December 2020 will compete in 5 different categories, each defined by the type of traffic they send to: Dating, Nutra, iGaming and Sweepstakes. New affiliates who join the network during the period of the competition, or who joined the network after 1 December 2020 or have not generated will compete in the “Newcomer” category. All groups of affiliates are eligible to compete in the “Wild Card” category. Two winners in this category will be determined through a draw.
The contest starts on 1 February 2021 and ends on 1 April 2021, CET. Each affiliate or company may only win in one category. In case one affiliate wins in two or three categories, the next runner-up from those categories will be selected to replace the slot.
The Company offers as a prize to the winners in each category an all-expenses-paid trip to Amsterdam from 17 September 2021 to 21 September 2021 (4 nights). 7 total winners will be chosen from 5 different categories: Top Dating Affiliate (the affiliate who earns the most points from Advidi Dating offers from 1 February - 1 April 2021); Top Nutra Affiliate (the affiliate who earns the most points from Advidi Nutra offers from 1 February - 1 April 2021); Top Sweepstake Affiliate (the affiliate who earns the most points from Advidi Sweepstakes offers from 1 February - 1 April 2021); Top iGaming Affiliate (the affiliate who earns the most points from Advidi iGaming offers from 1 February - 1 April 2021); Top Newcomer (the affiliate who earns the most points in any vertical and who joined Advidi network no earlier than 1 December 2020 or has not generated more than $500 in the past 6 months) and Wild Card (2 randomly selected additional winners; each point earned during the competition receives one entry into the random drawing). Each winner in each category must have reached a threshold of $60,000 in revenue generated in the course of The Contest in order to be eligible for the prize.
The points will be calculated based on the revenue that each participant earns with The Company in the period of the Contest. Every $1000 in revenue will earn one point. In the case that the top 2 Participants have an equal number of points, the Participant who has generated more revenue toward the next point as of the last day of the Contest will earn an additional point and will be considered the winner.
Additional points can be earned through the Five Elements. There are Five Elements: Earth, Air, Water, Metal and Fire.
Earth Card: If a Participant refers a new affiliate that generates at least $1,000 in revenue each before the contest ends, they will earn 2 bonus points in total. The Participant can refer multiple affiliates. (There must be different bank accounts to which the money is transferred to prove that they are different people.)
Water Card: For all points a Participant earns in verticals other than their primary contest vertical, the Participant will receive 50% bonus points. This card can be used for traffic sent between Dating and non-Dating (Nutra, Sweepstakes and iGaming) verticals. For example, if a Participant’s primary contest vertical is determined to be Dating, and they generate $3000 of revenue in Mainstream, they will earn 4.5 points (instead of 3). The Company reserves the right to determine each Participant’s primary contest vertical.
Fire Card: The Contest will be divided into four 2-week cycles for the purpose of determining the Fire Card. If a Participant’s revenue increases between cycles, then the points earned during the latest completed cycle will be increased by 10%. If the Participant’s revenue is lower than a previous cycle at the end of any cycle during the competition, they will no longer be eligible for these bonus points for the remainder of the contest. The first cycle will be determined by the Participant’s revenue during the two-week period before the competition begins. Participants who join Advidi during the competition still have the chance to use the Fire Card. Their reference cycle will be 0, but they will have to show continuous growth in each next cycle to earn additional points from the booster.
Metal Card: We will locate your most successful month within Advidi ever. You have the chance to beat this PR within the period of the competition. If you do, we will match that with 30% extra points.
Air Card: Participants may earn double points on Special Offers during The Contest. The Company will send a list of special offers to every Participant through which the Participants can earn double points. If the Participant sends traffic to those offers within the specified period of time, every earned point during that period of time will be doubled. The list of special offers will be updated every two weeks, and the cycle will be calculated from the first Friday midnight (00:00 CET) after the email is sent. The offers are valid for double points for two weeks, and then new offers will replace the previous ones.
The email with the special offers will be sent to the email address filled out by the Participant in the application form. The Company takes no responsibility if the Participant doesn’t receive the weekly email because of an incorrect email address, or any other technical reasons.
Prizes are only applicable during the timeframe 17th - 21st September 2021 in Amsterdam, the Netherlands. The winners will be chosen based on points earned through revenue (chargebacks/refunds excluded) and additional points earned through The Contest, confirmed by The Company and generated during the timeframe 1 February - 1 April 2021, and only if the eligibility threshold has been reached per Participant. Winners will be contacted and informed by 4 April 2021 at the latest. If the winner of a category has not reached the minimum eligibility threshold, The Company reserves the right to appoint a new winner for that category.
In case of breach of the terms and conditions, or in case of non-compliance, fraud or any other kind of damage towards The Company and/or its partners, The Company reserves the right to exclude the Participant from the contest with immediate effect. When excluded from the contest, the Participant may not claim any kind of compensation from The Company.
Each week of the Contest, based on the previous week's performance, all Contestants that go above the $7k threshold will automatically go into the draw to win a prize. With each $1k in revenue over $7k the Contestant will receive an additional entry.
Prizes are subject to availability in each country. If the announced prize is not available in a Contestant’s country then a gift voucher for the same amount of the prize will be issued.
Travel and accommodation conditions
For all 7 winners, round-trip air transportation, along with 4 nights accommodation, will be provided. The air transportation to Amsterdam will be based on coach class tickets from a major, international airport closest to the winner’s residence. All travel must begin and end with the same major airport and same airline. The airline is selected at the sole discretion of The Company. Should affiliates arrange their own stopovers, open-jaw ticket, circle trips, frequent flyer mileage or any other trip modifications, The Company will reimburse the winner up to the amount of the original ticket price. Once the ticket is issued to the winner, additional change fees must be paid by the winner. A change in airline, flights or dates of travel, or any additional costs including, but not limited to, seat assignments, baggage fees, and in-flight purchases will be the responsibility of the winner. Contest winners who miss their flights will be required to pay for any additional flight changes to attend the event.
Should the winner(s) be unable to attend, the next runner up will be selected to replace the slot from the same category. The trip is non-refundable and non-transferable. Should the winner be a company, only one person shall represent that company as a winner. No cash alternative to the prize is offered and no substitutions are allowed.
The participant is fully responsible for all required travel documents.
For all winners, ground transportation from Schiphol airport in Amsterdam to their hotel is provided, as well as transportation from the hotel to Schiphol airport on the date of their return.
The hotel is selected at the sole discretion of The Company. Every winner will be accommodated in a separate room. All general costs for accommodation will be covered by The Company. Additional costs made by the winner(s) in terms of, but not limited to, extra hotel services, phone services, room services, and/or room damages, must be paid by the winner.
We will live up to the Participant’s rights to privacy and confidentiality of personal information. Information provided will be used for the purposes of this Contest. The Participant is responsible for the confidentiality of his password and/or access to their affiliate account. The company is not responsible and will not compensate any damages occurred by third-party access to their account.
Each party (The Company and the Participant) agrees to indemnify, defend and hold harmless the other party and its employees, agents, officers and directors, against any and all claims, causes of actions, judgments, demands, damages, losses or liabilities, including costs and expenses (including reasonable attorneys fees and costs of suit), arising out of or relating to (a) any claim based upon infringement of copyright, trademark, patent, or trade secret or other intellectual property rights of any third party; (b) any claim, representation, or statement made in the Advertisement; (c) any breach of any representation or warranty contained in The Contest.
Limitations of liability
IN NO EVENT SHALL THE COMPANY BE LIABLE FOR ANY SPECIAL, INDIRECT, INCIDENTAL OR CONSEQUENTIAL DAMAGES (INCLUDING, WITHOUT LIMITATION, FOR BREACH OF CONTRACT, WARRANTY, NEGLIGENCE OR STRICT LIABILITY), OR FOR INTERRUPTED COMMUNICATIONS, LOSS OF USE, LOST BUSINESS, LOST DATA OR LOST PROFITS, ARISING OUT OF OR IN CONNECTION WITH THE CONTEST.
The Company maintains the right to terminate, adjust or suspend The Contest in case of extraordinary circumstances including, but not limited to: fraud, hacking, viruses or other issues that negatively impact the normal and secure course of The Contest.
The Company shall not be held responsible or liable for any losses, direct or indirect damages, costs and/or expenses arising from any delay or failure in performance of any part of the Contest due to an act of God, act of governmental authority, act of a public enemy or due to war, riot, flood, civil commotion, insurrection, labor difficulty, severe or adverse weather conditions, lack or shortage of electrical power, failure of performance by any third party hosting service or equipment provided or maintained by others, including general performance of the Internet itself, or any other cause beyond the reasonable control of The Company.
